Make names, translations and source documents traceable.

A China partner visa file may combine Chinese-language civil records, English translations and Australian documents. Each translated item should be identifiable, and the names and dates used across the application need to point to the same person and event.

🇪🇳

Original document plus English translation

Home Affairs says non-English documents must be translated and both the original and translated document submitted. Translation requirements differ depending on whether the translator is in Australia or overseas.

👤

Name order and Roman-letter spelling

Check how each name appears in the passport, translations, earlier visa records and relationship documents. If spacing, order or Roman-letter spelling differs, identify the reason rather than allowing the records to appear to concern different people.

Current China processing questions

The Department maintains a China visa-office enquiry route for applications processed there. Use current Home Affairs and ImmiAccount instructions rather than relying on an old checklist or an unofficial document list.

China to Australia partner visa pathways

Start with the applicant's location and relationship status.

The correct pathway depends on where the applicant is, whether the couple is married, de facto or engaged, the current visa position and whether a valid application can be made. Chinese citizenship alone does not determine the subclass.

309 and 100 offshore

Often considered where the applicant is outside Australia. The applicant and Australian sponsor coordinate a combined provisional and permanent partner visa application.

Subclass 300 prospective marriage

A separate pathway for some engaged couples intending to marry within the visa period, followed by a later partner visa application if its requirements are met.

Explore subclass 300 →

820 and 801 onshore

Relevant only where the applicant is in Australia and can validly lodge the combined onshore application. Current visa conditions and timing must be checked.

Relationship evidence across China and Australia

Connect bilingual records to one relationship chronology.

Translations make a document readable; they do not explain why it matters. The evidence plan should connect each record to the couple's meetings, communication, finances, social recognition and future intentions.

Reference each translation clearly

Pair the English translation with the correct source record and use consistent document labels. Dates, issuing authorities and names should remain easy to trace when the application is reviewed in ImmiAccount.

Communication evidence with context

Messages, calls and photographs are more useful when dates and participants can be understood. Select a fair sample across the relationship and explain platform changes or genuine gaps without manufacturing continuity.

Travel and meetings across borders

Passport records, flights and time together should align with both partners' written histories. Where travel was disrupted or limited, describe how the relationship continued and what future arrangements were made.

Family recognition across languages

Statements from people who know the couple should describe their own observations. If a supporting statement or attachment is not in English, apply the current translation requirements rather than paraphrasing it informally.

How we help

Four steps to reuniting in Australia.

  • 1Assess your eligibility

Your relationship, your circumstances, and the right subclass — usually the offshore 309/100 or Prospective Marriage 300.

  • 2Build the evidence pack

Shared finances, communication records, travel history and statements — compiled and lawyer-reviewed against the agreed evidence plan.

  • 3Prepare the application for lodgement

We prepare and review the application against the agreed pathway, evidence plan and legal scope before submission.

  • 4Support through the decision process

We keep you updated and address additional Home Affairs requirements within the agreed scope while the application is considered.

Partner visa FAQs

Common questions, answered by lawyers.

How long does a partner visa take?

Processing times vary depending on the visa type and complexity of your case — current times change with the pathway, application and Department caseload. Check Home Affairs before relying on an estimate.

Can I apply in a de facto relationship?

The 12-month rule generally concerns the duration of the de facto relationship immediately before application, not simply a lease period; registered relationships and other exceptions can apply. We assess the facts before you rely on an exception.

What if my application is refused?

Review rights and deadlines depend on the decision, the applicant's circumstances and where they were when the application was made. Get the decision checked promptly and read our partner visa refusal guidance.

Is the first China partner visa call free?

Yes. The initial strategy call covers the proposed pathway, professional fees and next steps. Detailed legal advice or document review may require a separately agreed scope.

Can I include my children in the application?

Yes, dependent children can be included. You'll need to provide evidence of their dependency and meet specific requirements.

Do we need to meet you in person?

No — we work with clients in China and worldwide entirely by phone, WhatsApp or Zoom, with the same service we give clients in Brisbane.
